Driver With BAC More Than Double Legal Limit Busted For DWI In Westchester, Police Say

A Fairfield County man was arrested for allegedly driving with a blood alcohol content more than double the legal limit in Westchester, police said.

An officer from the Scarsdale Police Department on parol shortly after 9:10 p.m. on Friday, Aug. 9, stopped Stamford resident James McBrien, 39, on Mamaroneck Road after he was spotted driving slowly and swerving in a Lexus.

During the traffic stop, police said that McBrien had alcohol on his breath, his speech was slurred and he had glassy eyes.

While exiting the vehicle, officers stated that McBrien had multiple beer cans in the driver’s side door panel, most of which had already been consumed. McBrien proceeded to fail multiple Standardized Field Sobriety Tests, and was taken into custody.

At Scarsdale Police Headquarters, McBrien was charged with driving while intoxicated and aggravated driving while intoxicated with a blood alcohol greater than .18 percent. He was also cited for operating a motor vehicle without an inspection, having an open container in a vehicle, and driving to the left of pavement markings.

Following his processing, McBrien was released to a friend and is scheduled to appear in Scarsdale Village Court at a later date to answer the charges.
